Ohio Workers Comp Insurance

Owner, MVP Insurance

Ohio workers comp insurance works differently than in most states. Employers must buy their primary policy from the Ohio Bureau of Workers' Compensation (BWC), not a private insurer. You can lower that cost through group rating or group retro programs. Employers liability, which the state fund doesn't include, comes from a private stop gap policy.

That mix of state coverage and private add-ons trips up a lot of business owners, especially those who also run operations in Pennsylvania, where the rules are completely different. A contractor in Youngstown or a restaurant owner in Canton can stay compliant with the BWC and still be exposed to a lawsuit nobody warned them about. The sections below cover what the state handles, what it leaves out, and how to keep your premiums from creeping up year after year.

Understanding Ohio Workers Comp Insurance and the Monopolistic System

Ohio is one of only four monopolistic states, which means employers must get workers' compensation coverage through a state-run fund rather than shopping the open market. Here, that fund is the Ohio BWC. There's no bidding war between carriers for your workers comp policy and no option to move it to a different company at renewal.

This catches many employers off guard. A business owner who has always bought insurance by comparing quotes naturally expects to do the same here, then learns the state is the only seller. The upside is stability: Ohio's average premium rates sit at their lowest levels in more than 65 years, ranking fifth lowest nationally in the 2024 Oregon Rate Study.

Monopolistic doesn't mean hands-off, though. You still control a lot: which savings programs you join, how quickly injuries get reported, and whether your liability gaps get filled. MVP Insurance helps employers make sense of these state requirements and look at their overall risk profile, so the BWC policy fits into a broader plan instead of sitting alone.

How the Ohio BWC Monopolistic System Works

The Bureau of Workers' Compensation is the exclusive provider of medical and lost wage benefits for work-related injuries in Ohio. If an employee gets hurt on the job, the BWC pays the doctor bills and replaces a portion of lost income, funded by the premiums employers pay into the state system.

The scale is significant. The BWC manages roughly $24 billion in assets and serves between 245,000 and 258,000 employers across the state. Private carriers like Erie or Westfield, which write plenty of business insurance in Ohio, cannot provide the primary workers comp policy here. If someone offers to sell you a "private Ohio workers comp policy," that's a red flag.

Rates have been moving in employers' favor. Effective July 1, 2026, the BWC put in place a 1% average rate reduction for private employers, projected to save businesses around $10 million. Since 2019, private employer rates have dropped by a cumulative 50%. Public taxing districts saw their own 1% cut on January 1, 2026.

Some details vary by industry. For construction, the weekly wage cap for the July 2026 to June 2027 policy year is $1,922, which limits how much payroll per employee counts toward premium.

Lowering Costs Through Group Rating and Group Retro Programs

Employers can join group rating or group retro programs through a sponsor, typically a trade association or chamber, to get lower premium tiers or year-end rebates. These programs are generally open to employers with a solid safety record who meet specific eligibility criteria set by the BWC and the sponsor.

The two programs work differently:

  • Group Experience Rating: Similar employers are pooled so the group's combined claims history sets the rate. Members usually get a reduced premium upfront.
  • Group Retrospective Rating: You pay your normal premium, then receive a refund later if the group's claims come in lower than expected. Strong group performance can mean a meaningful check, but rebates aren't guaranteed.

Deadlines matter, and missing one means waiting a full year. As of this writing, the application deadline for Group Experience Rating for the policy year starting July 1, 2027, is November 23, 2026. Group retro enrollment for the 2027 policy year generally closes January 29, 2027.

A common mistake: an employer with one bad claim assumes they're shut out forever. Eligibility looks at recent history, and a year or two of clean results can reopen the door. Group retro programs also come with specific participation requirements worth reviewing with your sponsor before signing up.

Protecting Your Business with Stop Gap Employers Liability

BWC policies don't include employers liability coverage, so Ohio businesses should buy stop gap coverage from a private carrier like Erie or Liberty Mutual. Stop gap handles lawsuits tied to workplace injuries that fall outside what the state fund pays.

Here's a real-world type of claim. An employee is injured, collects BWC benefits, then sues the employer, alleging the company knowingly ignored a dangerous condition. That's an intentional tort claim, and the BWC won't defend it. Another example: a worker's spouse files a loss of consortium suit. Without stop gap, your legal defense and any settlement come out of company funds.

Stop gap is typically added as an endorsement to a general liability policy rather than bought as a standalone product. That's why reviewing your general liability insurance in Ohioat the same time makes sense. Many owners assume their GL policy already includes it. Often it doesn't, because the endorsement has to be requested.

Comparison of Ohio BWC vs. Private Stop Gap Coverage

Feature Ohio BWC Policy Private Stop Gap
Who provides it State of Ohio only Private carriers (Erie, Liberty Mutual)
Required by law Yes, for employers No, but strongly advised
Medical bills for injured workers Covered Not the purpose
Lost wage benefits Covered Not the purpose
Employee lawsuits against employer Not covered Covered, subject to policy terms
Legal defense costs Not included Typically included

Managing Claims Costs and Workplace Safety

Active claims management and consistent safety protocols are what keep BWC premiums manageable over time. Your claims history feeds directly into your experience rating, so one poorly handled injury can raise premiums for several years.

A few habits make a real difference:

  1. Report injuries fast. Delayed reporting often leads to higher medical costs and more disputes.
  2. Offer transitional or light-duty work. Getting an employee back on the job, even with modified tasks, shortens lost-time claims.
  3. Stay in contact with the injured worker. Employees who feel ignored are more likely to hire an attorney.
  4. Document safety training. Records help with eligibility for BWC programs and protect you if a claim is contested.
  5. Review your claims list yearly. Mistakes and lingering open claims happen, and catching them early protects your rate.

Fraud is part of the cost picture too. The BWC's Special Investigations Department identified $92 million in savings through fraud investigations in fiscal year 2025, which helps keep rates down for everyone. The BWC also offers safety programs and resources for employers who want to build a stronger safety culture.

The BWC has said that private employers have received 16 rate reductions in the last 17 years, and that "these rate cuts allow Ohio's employers to reinvest in their business and their employees." You get the most out of those cuts when your own claims stay under control.

How MVP Insurance Helps Ohio Employers Navigate the BWC

MVP Insurance helps Ohio employers manage the complexities of the BWC system and coordinate the private liability coverage the state leaves out. Because the BWC is the sole provider of the workers comp policy itself, our role is guidance and coordination, along with placing the private coverage that surrounds it.

That means helping you understand group rating and retro options, keeping deadlines on your radar, and making sure stop gap employers liability sits on your general liability policy where it belongs. As a 100% independent agency founded in 2008 by Josh Medure and David Varrati, MVP works for you, not a carrier, and shops coverage from companies like Erie, Westfield, and Liberty Mutual. You can explore the rest of your coverage needs on our business insurance in Ohiopage.

MVP has two offices serving the region: 13823 Grant St, New Springfield, OH 44443, (330) 707-9055, and 108 E Grandview Ave, Zelienople, PA 16063, (724) 453-1122. MVP Insurance is licensed in Ohio (#37714) and Pennsylvania (#519263), NPN 10588293.

Frequently Asked Questions About Ohio Workers Comp

Can I buy workers comp from a private insurance company in Ohio? No. Ohio is a monopolistic state, so your primary workers comp policy must come from the Ohio BWC. Private carriers can only sell related coverage like stop gap employers liability.

What is stop gap coverage in Ohio? Stop gap is employers liability coverage that protects you if an employee sues over a workplace injury. The BWC policy doesn't include it, so it's usually added to your general liability policy.

Who qualifies for Ohio group rating? Generally, employers with a solid safety record who meet BWC and sponsor criteria. You join through a sponsoring organization, not directly.

What's the difference between group rating and group retro? Group rating lowers your premium upfront based on the group's performance. Group retro has you pay the normal premium and then possibly receive a refund later.

When is the deadline to join group rating for 2027? As of this writing, private employers have until November 23, 2026, to apply for the policy year beginning July 1, 2027.

Does my Ohio workers comp cover employees working in Pennsylvania? Not necessarily. Multi-state operations often need separate coverage, so it's smart to review your setup with an agent who knows both states.

The state handles the core policy, but the gaps around it are yours to close. Talk with someone local before a lawsuit finds them first.
